CLI Capital understands and respects your right to privacy. This notice is provided to you in accordance with applicable federal and state law. This notice will help you to understand what types of nonpublic personal information (i.e. information about you that is not publicly available) CLI Capital may collect, how we use it, and how we protect your privacy.
During our relationship with you we have and will continue to gather certain information considered “nonpublic”, which is required in the normal course of business. Such information may include your social security number, address and information contained on your account, as well as, any information provided to us by others on your behalf, and information required by law, including applicable tax laws.
All information we collect about you and your account is deemed confidential and will not be disclosed, except under the following circumstances:
1. We may disclose personal information in those special circumstances where we believe that its disclosure is required or permitted by law; including without limitations, complying with regulatory examinations, audits by CLI Capital’s external auditors, complying with legal subpoenas, or in any legal action necessitated by your account or our relationship with you.
2. The information is required to complete a transaction with you or on your account.
3. The information is required to be disclosed by law; including, without limitation, applicable tax laws.
4. As necessary in normal business operations where we engage the services of a third party to assist in the administration of your account and such information is necessary to such third parties’ duties. In such event, we will require such third-party provider to subscribe to our privacy policy.
5. As necessary to protect and defend the rights and property of CLI Capital.
6. As necessary to enforce any agreements, liabilities, and/or obligations between you and CLI Capital.
7. We may disclose your information in a business transfer. As with any other business, we could merge with, or be acquired by, another company. If this occurs, the successor company would acquire the information we maintain, including personally identifiable information. However, personally identifiable information would remain subject to this Privacy Policy.
CLI Capital does not sell or rent nonpublic personal information about our account holders to anyone. Except as set forth above, CLI Capital will not share your personal information with third parties unless you specifically request us to do so in writing (also called “opting in”).
We maintain policies and practices that protect the security and confidentiality of our account holders’ information. These policies and practices include the following:
1. Access to account holder records is restricted to employees deemed to have a need for the information to perform their job duties for CLI Capital.
2. Maintenance and protection of information through appropriate security enhancing software.
3. Physical security of our building.
4. Backup and recovery procedures.
If, in its sole discretion, CLI Capital should ever elect to disclose nonpublic information about you to any third party and such disclosure does not fall within one of the exceptions to non-disclosure, listed above, we will advise you in advance of such action and afford you the opportunity to elect not to allow CLI Capital to disclose your information (also referred to as “opting out”).
CLI Capital, in its sole discretion, may change this Privacy Policy at any time by sending the revised Privacy Policy to you. The revised Privacy Policy is effective immediately upon CLI Capital mailing it to you. It is your responsibility to review any revised Privacy Policy.
